TruCutter, Inc. – Master Terms & Conditions

1. Payment Terms

Payment is due upon completion of the work unless otherwise agreed to in writing. Deposits may be required for certain projects.

2. Insurance Claims

For insurance-related work, the property owner is responsible for payment of any applicable deductible. Unless otherwise agreed in writing, deductibles are due prior to the start of work.

3. Credit Card Processing Fee

A 3% processing fee will be added to all payments made by credit card.

4. Underground Utilities

The customer is responsible for identifying and marking all private underground utilities and property improvements prior to the start of work, including but not limited to irrigation systems, invisible pet fencing, septic systems, private electrical lines, landscape lighting, drainage systems, and private water or gas lines. Public utility locates do not identify private utilities. TruCutter, Inc. is not responsible for damage to unmarked or improperly identified private underground utilities or improvements.

5. Heavy Equipment & Property Access

Tree work often requires the use of heavy equipment, including trucks, cranes, loaders, skid steers, stump grinders, and other machinery. While reasonable care will be exercised, TruCutter, Inc. is not responsible for incidental damage to lawns, landscaping, irrigation, sidewalks, driveways, curbs, or other property resulting from normal access and operation of heavy equipment when such access is necessary to perform the contracted work.

6. Additional Work

Any work requested beyond the original scope of the accepted estimate may require additional charges. If unforeseen conditions require additional labor, equipment, materials, or a change in the scope of work, TruCutter, Inc. will notify the customer of any additional charges before proceeding with the additional work.

7. Delays Beyond Our Control

Estimated work dates are subject to change due to weather, emergency storm response, equipment failure, utility conflicts, acts of God, or other circumstances beyond TruCutter, Inc.’s reasonable control.

8. Hazard Discovery

If hidden hazards or unforeseen conditions are discovered during the course of the work—including decay, structural defects, unstable trees, concealed objects, underground obstructions, hazardous materials, or other unsafe conditions—additional work, equipment, or charges may be necessary to safely complete the project.

9. Authorized Representative

By accepting the estimate, the customer represents that they are the property owner or have the legal authority to authorize the work and agree to these Terms & Conditions on behalf of the property owner.

10. Customer Responsibility for Personal Property

The customer agrees to remove or protect all vehicles, trailers, equipment, outdoor furniture, grills, decorations, potted plants, toys, and other personal property from the designated work area and any established safety or exclusion zone identified by TruCutter, Inc. before work begins. While TruCutter, Inc. will exercise reasonable care during operations, it is not responsible for damage to personal property left within these areas.

11. Tree Health Disclaimer

Tree work involves living organisms and natural conditions beyond our control. TruCutter, Inc. makes no warranty or guarantee regarding the future health, survival, stability, or condition of any tree following pruning or other services unless expressly stated in writing.

12. Stump Grinding

Unless otherwise specified in the accepted estimate, stump grindings, wood chips, and other organic material generated during stump grinding will be left on site. TruCutter, Inc. is not responsible for normal settling, depressions, sinkage, or changes in grade that may occur following stump grinding or as underground roots decompose over time.

13. Limitation of Liability (Optional – Attorney Review Recommended)

To the fullest extent permitted by Georgia law, TruCutter, Inc.’s liability for any claim arising out of the services provided shall not exceed the amount paid by the customer for the specific services

giving rise to the claim. TruCutter, Inc. shall not be liable for indirect, incidental, consequential, or special damages except where prohibited by law.

14. Estimated Scheduling (Optional)

Any proposed or scheduled service date is an estimate only and is not guaranteed. TruCutter, Inc. reserves the right to reschedule work due to weather, emergency storm response, equipment availability, site conditions, utility conflicts, safety concerns, or other circumstances beyond its reasonable control.

15. Photographs (Optional)

TruCutter, Inc. may photograph the property before, during, and after the project for documentation, insurance purposes, quality control, and marketing. No personal identifying information or street address will be published without the customer’s permission.
